Welcome to SRVIX's Terms of Service! Chanwoo Lee, doing business as SRVIX ("we," "us," or "our"), is a cloud hosting service provider. The first portion of our Terms of Service is an introduction, which is structured like an FAQ and lays out some high-level concepts before diving into other terms.

What documents make up the TOS?

These Terms of Service ("Terms") govern your use of the hosting services ("Services") provided by Chanwoo Lee, doing business as SRVIX ("we," "our," or "us"). By accessing or using our Services, you agree to be bound by these Terms.

What services does SRVIX provide?

SRVIX provides cloud infrastructure services including:

  • Virtual Private Servers (VPS)
  • Cloud Storage and Backup Solutions
  • Load Balancers and CDN Services
  • Database Hosting

How do I create and manage my account?

To use our Services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your account information remains accurate and up-to-date

What are the acceptable use policies?

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit or store malicious code, viruses, or harmful content
  • Engage in unauthorized access to systems or networks
  • Distribute spam, phishing emails, or other unsolicited communications
  • Host content that is illegal, defamatory, or violates intellectual property rights
  • Engage in activities that could harm our infrastructure or other users
  • Use our Services for cryptocurrency mining without explicit permission
  • Run resource-intensive applications that may impact other users

You are solely responsible for all content, data, and applications hosted on our Services. We do not monitor or review content, but we reserve the right to remove or disable access to any content that violates these Terms.

What is the service availability and uptime?

We strive to provide 99.9% uptime for our Services. However, we do not guarantee uninterrupted service and may perform maintenance that could temporarily affect availability.

We may perform scheduled maintenance with reasonable notice. Emergency maintenance may be performed without prior notice to ensure service security and stability.

How is my data and privacy protected?

You retain ownership of all data you store on our Services. We do not claim ownership of your content.

We implement reasonable security measures to protect your data. However, you are responsible for:

  • Implementing appropriate security measures for your applications

How does billing and payment work?

Service pricing is available on our website and may be subject to change with 30 days' notice. All prices are exclusive of applicable taxes.

Payment is due in advance for all Services. We accept major credit cards and other payment methods as indicated on our website. Late payments may result in service suspension or termination.

Refund Policy

Refunds are available upon request and are calculated based on the portion of the service term used.

A non-refundable setup fee applies to all refunds to cover payment processing and administrative costs.

For prepaid plans with promotional discounts (e.g., annual plans that include free months), the discounted months are excluded from refund eligibility. Once the paid portion of the term has been consumed, no refund will be issued.

Example: A 12-month prepaid plan with 2 free months is billed as 10 months. After 10 months of use, no refund is available.

Non-refundable items include domain registrations, renewals, transfers, SSL certificates, third-party licenses, and services terminated for Terms of Service violations.

What are the service limitations and restrictions?

Your use of our Services is subject to reasonable usage limits. Excessive resource consumption may result in throttling or suspension of services.

Bandwidth and storage limits are specified in your service plan. Additional usage may incur additional charges.

How can the agreement be terminated?

You may terminate your account at any time through our control panel or by contacting support. Upon termination, you will lose access to all data and services.

We may terminate or suspend your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Fail to pay fees when due
  • Use our Services in a manner that could harm our infrastructure

Upon termination, we may delete all data associated with your account. We recommend backing up your data before terminating your account.

What about intellectual property rights?

Our Services, including all software, technology, and content, are owned by SRVIX and are protected by intellectual property laws. You retain ownership of your content but grant us a license to host and serve it.

What are the limitations of liability?

Our Services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall SRVIX be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to these Terms or your use of our Services.

Our total liability to you for any claims arising out of or relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

What about indemnification and other legal matters?

You agree to indemnify and hold harmless SRVIX, its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of our Services or violation of these Terms.

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, or internet service provider failures.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where SRVIX is incorporated. Any disputes shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration association.

We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or through our website. Your continued use of our Services after such changes constitutes acceptance of the new Terms.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and SRVIX regarding your use of our Services.
